Terms of Service

Welcome to GoodListen ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of the GoodListen website, mobile application, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Eligibility

You must be at least 13 years old (or 16 years old if residing in the European Economic Area) to use the Service. By using the Service, you represent and warrant that you meet the eligible age requirement.

2. User Accounts

To access certain features, you may need to register for an account. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. User-Generated Content (UGC) and Acceptable Use Policy

GoodListen allows users to share thoughts, create playlists, comment, and engage in social networking features ("User Content").

ZERO TOLERANCE POLICY: We have a zero-tolerance policy for objectionable content or abusive users. You agree NOT to post, share, or transmit any User Content that:

  • Is defamatory, abusive, harassing, threatening, or constitutes hate speech.
  • Contains nudity, sexually explicit material, or pornography.
  • Promotes illegal activities, violence, or self-harm.
  • Infringes on the intellectual property rights, privacy rights, or other rights of any third party.

Enforcement: GoodListen reserves the right, but not the obligation, to review, monitor, and remove User Content at any time, for any reason, without notice.

Blocking and Reporting: As required by app store guidelines, users have the ability to:

  • Report objectionable content or behavior using the in-app reporting tools.
  • Block abusive users to prevent further interaction.

We will act on user reports of objectionable content within 24 hours by removing the content and ejecting the user who provided the offending content.

4. Intellectual Property

GoodListen claims no ownership over your User Content. However, by posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content to provide and improve the Service.

All original content, features, and functionality of the Service (excluding podcasts provided by RSS feeds) are owned by GoodListen and are protected by international copyright, trademark, and other intellectual property laws. Podcasts are the property of their respective creators and are indexed via public RSS feeds according to fair use principles.

5. DMCA / Copyright Policy

If you believe that your copyrighted work has been copied or used in a way that constitutes copyright infringement, please contact our designated Copyright Agent at contact@goodlisten.app. Please include a description of the copyrighted work, exactly where it is located on the Service, and a statement made under penalty of perjury that you are the copyright owner.

6. Subscriptions and Payments

Certain features of the app may require payment or a subscription. Pricing and terms of subscriptions will be presented at the point of purchase. Subscriptions may be billed through your respective app store (Apple App Store or Google Play) or other supported payment methods available at the time of purchase, and will follow the specific billing and cancellation policies of the chosen payment provider.

7. Account Termination and Deletion

You may request to permanently delete your account at any time through the "Settings" menu within the app or website. Upon your request, your account and all associated personal data will be scheduled for permanent deletion and will be removed from our active servers within 30 days. We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

8. Disclaimers and Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties of any kind, whether express or implied. To the maximum extent permitted by law, GoodListen shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of California, United States, without regard to its conflict of law principles.
